DMCA Policy

1. Introduction

Software HCS Network respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998, the text of which may be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, Software HCS Network will respond expeditiously to claims of copyright infringement committed using the Software HCS Network website and/or services (the "Service") if such claims are reported to Software HCS Network's Designated Copyright Agent identified in the sample notice below.

2. DMCA Notice of Alleged Infringement ("Notice")

If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Service by completing the following DMCA Notice of Alleged Infringement and delivering it to Software HCS Network's Designated Copyright Agent. Upon receipt of the Notice as described below, Software HCS Network will take whatever action, in its sole discretion, it deems appropriate, including removal of the challenged material from the Service.

3. DMCA Notice of Alleged Infringement ("Notice")

Identify the copyrighted work that you claim has been infringed, or - if multiple copyrighted works are covered by this Notice - you may provide a representative list of the copyrighted works that you claim have been infringed.

Identify the material or link you claim is infringing (or the subject of infringing activity) and that access to which is to be disabled, and information reasonably sufficient to permit us to locate the material.

Provide your contact information, including your name, address, telephone number, and email address.

Provide a statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

Provide a statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Sign the notice with either an electronic signature or your physical signature.

4. Filing a DMCA Complaint

If you believe that material available on our website infringes on your copyright(s), please send us a written notification with the details specified above to our Designated Copyright Agent at:

5. Once Proper Bona Fide Infringement Notification is Received by the Designated Agent

Upon receipt of a proper notice of claimed infringement, Software HCS Network will take the following actions:

  • Remove or disable access to the infringing material.
  • Notify the content provider who is accused of infringement.
  • Provide the content provider with your contact information.

6. Procedure to Supply a Counter-Notice to the Designated Agent

If the content provider believes that the material that was removed (or to which access was disabled) is not infringing, or the content provider believes that it has the right to post and use such material from the copyright owner, the copyright owner's agent, or pursuant to the law, the content provider may send us a counter-notice containing the following information to the Designated Agent:

  • A physical or electronic signature of the content provider.
  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  • A statement under penalty of perjury that the content provider has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • The content provider's name, address, telephone number, and, if available, email address.
  • A statement that the content provider consents to the jurisdiction of the Federal District Court for the judicial district in which the content provider's address is located, or if the content provider's address is located outside the United States, for any judicial district in which Software HCS Network is located.
  • A statement that the content provider will accept service of process from the person who provided notification of the alleged infringement.

If a counter-notice is received by the Designated Agent, Software HCS Network may send a copy of the counter-notice to the original complaining party informing that person that it may replace the removed material or cease disabling it in 10 business days. Unless the copyright owner files an action seeking a court order against the content provider accused of committing infringement, the removed material may be replaced or access to it restored in 10 to 14 business days or more after receipt of the counter-notice, at Software HCS Network's discretion.
